NOTICE REGARDING FUTURE CHANGES TO TERMS:

We may make changes to the Terms at any time. Any changes we make will be effective immediately when we post a revised version of the Terms on the Site. The “Last Updated” date above will tell you when the Terms were last revised. By continuing to use this Site or participating in any event after that date, you agree to these changes.

To the extent that these Terms differ from a prior version of the Terms which you previously agreed to, this version of the Terms supersedes and governs.

1. WHY DOES Ocean Posse REQUIRE THAT EVERY PARTICIPANT SIGN AND AGREE TO THIS?

There are three main reasons you are signing this liability waiver:

A) to document in writing that you have been warned of potential risks a
B) to remove their responsibility for injuries that arise from negligence
C) media use
 

2. WHAT DOES IT MEAN TO WAIVE LIABILITY?

A liability waiver is a legal document that a person who participates in an activity may sign to acknowledge the risks involved in their participation. In exchange for the opportunity to participate in certain Ocean Posse events and services, you agree to not bring any claims against Ocean Posse related to injury, illness, property damage, theft, and loss unless the claim is caused by Ocean Posse gross negligence or willful misconduct.

 

3. HOW DOES Ocean Posse USE THE PHOTOS OR VIDEOS TAKEN DURING THE EVENT?

Ocean Posse primarily takes recordings screenshots and videos during events to share with participants, media and others in follow-up communications.
Clients have sometimes requested access to and use of Ocean Posse photos for use in their own communications. This waiver also allows us to share Ocean Posse photos with these client, upon request.

Occasionally Ocean Posse will use photos and videos for external purposes (for example, on social media posts about the event).  

 

4. THE WAIVER MANDATES PERMISSION TO RECORD ME AND MY VOICE. WILL Ocean Posse  BE RECORDING DURING THE EVENT?

Ocean Posse may record teaching portions of the event to be used for training  Ocean Posse apprentices, sailors and others and developing our virtual offerings. This content is never shared publicly. The Zoom platform records only the “speaker view,” so it records the trainers and may only sometimes include question and answers. We will stop recording when confidential information is being shared with the main group and will not record breakout rooms.
Occasionally Ocean Posse will use photos or segments of recording for external purposes. The content of these recordings is almost always teaching from our Ocean Posse team. In the event that Ocean Posse   does record, Ocean Posse respects the privacy of participants and will never publicly reveal participant identities in connection with their personal stories or information.

 

 

5. I AM COMFORTABLE WITH PHOTOS OF ME BEING SHARED WITH THE INTERNAL GROUP, BUT I DO NOT WANT Ocean Posse TO USE THEM EXTERNALLY. IS THAT POSSIBLE?

No   – don’t come if that’s the case

 

6. I DO NOT WANT ANY PHOTOS TAKEN OF ME DURING THE EVENT. CAN I STILL ATTEND?

We ask that all participants have their video on during our events to prioritize connection and relationship. Unfortunately, with Zoom, recorded or live events it is impossible to omit individual participants from screenshot images, so it is not possible to accommodate this request for our virtual or physical events.
